RIBA Building Contracts: Concise & Domestic

23rd April 2019 - Sarah Lupton

Time-Bar Provisions (claims by contractor)

CBC = Concise

DBC = Domestic

DBC

- no adjudication, otherwise it would comply with Housing Grants Act

The Contracts: Overview

- Deed, 6 or 12 year?

- tricky to change a clause

- restriction on contractor's working hours

- almost no limit on how high to set liquidated damages

Contract Administrator: Quality

- JCT puts more positive obligations on the Architect

- Museum of Liverpool

- Tolerances, CDP as liability

- DBII clause 2.11 (CAR!)

- Don't change clauses, knock-on effect on other clauses

- concurrent delay

Cost

- Client shouldn't evaluate the works and pay less than amount certified

- no pay-less notice in DBC? Despite legal precedent

Termination & Disputes

- no Contract Admin. in JCT D&B (CAR)

- when are provisional sums paid?
